Terms of Service – Darkside Project Store

These Terms of Service (“Terms”) form a legally binding agreement between you (“the Customer”) and Darkside Project (“the Store”) for purchases made through our Tebex shop or any other payment method we use. By making a purchase, donation, or contribution, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Nature of Goods & Instant Delivery

1.1 All products sold through this store are intangible, non-physical digital goods.
1.2 Delivery is made automatically upon successful payment processing. Once delivery has been completed, you will have immediate access to the purchased item(s).
1.3 By completing a purchase, you acknowledge that:

  • There is no physical item to ship or return.

  • You waive any right to a “cooling-off” period or refund under applicable consumer laws, to the fullest extent permitted.

2. No Refund Policy

2.1 All sales are final. Refunds will not be issued under any circumstances, including but not limited to:

  • Dissatisfaction with the product or service.

  • Server changes, closures, or downtime.

  • Inability to access the server due to account bans, suspensions, or technical issues on your end.
    2.2 This policy applies regardless of your level of usage after purchase.

3. Chargebacks & Payment Disputes

3.1 Filing a payment dispute or initiating a chargeback through PayPal, your bank, or any payment processor is strictly prohibited.
3.2 Initiating a dispute will be considered a breach of contract and will result in:

  • An immediate and permanent ban from our server and all related services.

  • Submission of full evidence to the payment processor, including proof of purchase, delivery logs, and these Terms.

  • Possible legal action or engagement of a debt collection agency to recover the original payment amount plus any fees incurred.
    3.3 By purchasing, you agree that digital delivery of your item(s) constitutes proof of fulfillment.

4. Ownership of Assets, Donations, & Contributions

4.1 Any and all assets, scripts, models, textures, designs, code, or other content that are purchased, commissioned, or paid for in full or in part for use on any Darkside Project server become the exclusive property of Darkside Project.
4.2 This includes, but is not limited to:

  • Items purchased directly through our Tebex store.

  • Assets acquired through player donations or financial contributions.

  • Custom commissions or third-party content paid for on behalf of Darkside Project.
    4.3 Donating funds or paying for assets does not grant you ownership rights to the asset itself. Instead, you are granting Darkside Project full and unrestricted rights to use, modify, redistribute, or retire the asset at our discretion.
    4.4 Such assets may not be:

  • Taken to other servers.

  • Resold, redistributed, or modified for use outside of the Darkside Project ecosystem.
    4.5 If you leave or are removed/banned from the server, your access to these assets is revoked without refund.
    4.6 All intellectual property rights remain with Darkside Project.

5. Server Access & Rule Enforcement

5.1 Purchasing from or donating to this store does not guarantee permanent or unconditional access to our server.
5.2 If you are banned, suspended, or otherwise removed from the server for violating server rules, you are not entitled to a refund or replacement of purchased items.

6. Customer Responsibility

6.1 You are solely responsible for entering the correct account details (e.g., Steam ID, Minecraft username, Discord ID) during checkout.
6.2 If incorrect information is provided, we are not responsible for failed delivery, and no refund will be issued.

7.1 All payments are securely processed by Tebex Limited (Merchant of Record).

9. Governing Law & Jurisdiction

9.1 These Terms shall be governed by and construed in accordance with the laws of The United States.
9.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Texas and Californa.
